01 — Terms of Service

Terms of Service

These Terms of Service govern your use of the Property Aster platform, including all verticals, tools and services available through propertyaster.ae and associated applications. By accessing or using the platform you agree to these terms in full.

1.1 Acceptance of Terms

By creating an account, accessing any part of the Property Aster platform or using any of its services, you confirm that you have read, understood and agree to be bound by these Terms of Service and all applicable laws and regulations of the GCC jurisdictions in which you operate.

If you are using the platform on behalf of a company, agency or other legal entity, you represent that you have the authority to bind that entity to these terms. If you do not have such authority, you must not use the platform.

1.2 Eligibility

To use Property Aster you must be at least 18 years of age and legally capable of entering into binding contracts under the laws of your jurisdiction. Where professional licensing is required — such as RERA broker licensing in Dubai or REGA registration in Saudi Arabia — you must hold and maintain a valid licence to use the relevant verticals.

Agents & Brokers
Must hold a valid licence issued by the relevant GCC regulatory authority (RERA, REGA, QCB or equivalent) to access transaction verticals.
Developers
Must be a registered developer or authorised representative with the applicable regulatory body in the market of operation.
Property Managers
Must hold relevant management authority or a signed management mandate for each property listed on the platform.
Mortgage Brokers
Must be registered with CBUAE or the equivalent regulatory body for mortgage advisory services in the operating market.
1.3 Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials. You must notify Property Aster immediately at security@propertyaster.ae if you suspect any unauthorised access to your account.

You are solely responsible for all activity that occurs under your account, whether or not you authorised it. Property Aster will not be liable for any loss resulting from unauthorised use of your account where you failed to take reasonable steps to protect your credentials.

1.4 Prohibited Uses
Listing properties you do not have authority to represent or sell
Submitting false or misleading information to DLD, RERA, REGA or any other regulatory body through the platform
Using the platform to facilitate transactions that circumvent applicable property laws or regulations
Scraping, copying or redistributing platform data without express written consent
Attempting to reverse-engineer, decompile or extract source code from any part of the platform
Using the platform in any way that violates UAE Federal Law, Saudi Arabian law or the laws of any GCC jurisdiction
Impersonating another user, agent or property professional
Circumventing or attempting to circumvent any security, access control or rate-limiting mechanism
1.5 Service Availability

Property Aster aims to provide continuous platform availability but does not guarantee uninterrupted access. Scheduled maintenance, emergency updates and factors outside our control may cause temporary unavailability. We will provide reasonable advance notice of planned downtime where possible.

We reserve the right to suspend or terminate access to any part of the platform at any time, with or without notice, where we have reasonable grounds to believe a user has violated these terms or applicable law.

02 — Privacy Policy

Privacy Policy

This Privacy Policy explains what data Property Aster collects, how it is used, where it is stored and what rights you have over it. It applies to all users of the platform across all GCC markets.

2.1 Data We Collect

We collect information you provide directly — name, contact details, professional licence numbers, company information — as well as data generated by your use of the platform, including transaction records, listing activity, communication logs and compliance submissions.

Identity Data
Name, email address, phone number, Emirates ID or equivalent national identification, professional licence number.
Transaction Data
Property transaction records, payment history, contract data, DLD/REGA registration records generated through the platform.
Usage Data
Login timestamps, feature usage, search history, device information, IP address and browser type.
Compliance Data
Regulatory submissions, licence verification records, EJARI registrations, DTCM permits and equivalent compliance documentation.
2.2 How We Use Your Data
To operate the platform and deliver the services you have contracted for
To enforce regulatory compliance with RERA, REGA, DLD, DTCM and other applicable frameworks
To verify your identity and professional licences against the relevant regulatory registers
To process transactions and generate the required regulatory documentation
To communicate service updates, compliance changes and account notifications
To detect and prevent fraudulent activity, unauthorised access and platform abuse
To improve the platform based on aggregated, anonymised usage data
We do not sell your data. Property Aster does not sell, rent or share personal data with third parties for commercial purposes. Your data is used solely to operate the platform and fulfil our legal and regulatory obligations.
2.3 Data Storage & Residency

All data generated by GCC users is stored on servers physically located within the Gulf Cooperation Council. Our primary infrastructure is hosted in the United Arab Emirates, with secondary replication in the Kingdom of Saudi Arabia. No GCC user data is transferred to or stored on servers outside the region.

Data is retained for the period necessary to fulfil the purposes for which it was collected. Regulatory records — including DLD transaction records, RERA compliance submissions and DTCM permit documentation — are retained for the minimum period required by the applicable regulation, typically 5–10 years.

2.4 Your Data Rights
Right of access — You may request a complete copy of all personal data we hold about you at any time.
Right to rectification — You may request correction of any inaccurate personal data.
Right to deletion — You may request deletion of your data. Regulatory records required by law cannot be deleted.
Right to portability — You may request export of your data in a standard machine-readable format.
Right to object — You may object to processing of your data for marketing or profiling purposes.
Right to restrict — You may request restriction of processing in certain circumstances.

03 — Regulatory Framework

GCC Regulatory Compliance

Property Aster operates under and enforces the regulatory requirements of every GCC market it serves. Compliance is not optional on this platform — the correct regulatory framework is applied automatically for each transaction, leasing agreement, permit or registration.

Automatic compliance enforcement: You do not need to manually track or submit to the above frameworks for transactions completed through Property Aster. The platform generates the required records, submits to the correct authority and stores the compliance documentation automatically.
04 — Agent Obligations

Agent & Professional Obligations

Real estate agents, brokers, property managers, mortgage advisors and developers using Property Aster must comply with the obligations of their professional licence and the applicable GCC regulatory framework at all times.

4.1 Licence Verification

Property Aster verifies agent and broker licences against the relevant regulatory registers at the time of registration and periodically thereafter. Accounts found to be operating with an expired, suspended or revoked licence will be suspended pending verification.

You are responsible for maintaining a valid, current professional licence for all markets in which you operate on the platform. If your licence is suspended or revoked by a regulatory authority, you must notify Property Aster immediately at compliance@propertyaster.ae.

4.2 Listing Accuracy

All property listings published through the platform must be accurate, current and authorised. You must have written authority from the property owner or their legal representative to list any property. Property Aster may request proof of listing authority at any time.

Publishing a property listing without valid owner authority is a violation of RERA regulations in Dubai and REGA regulations in Saudi Arabia, and may result in regulatory penalties and account suspension on this platform.
4.3 Transaction Conduct

All transactions conducted through or originated through Property Aster must comply with the applicable laws of the jurisdiction in which the property is located. This includes anti-money laundering obligations under UAE Federal Law No. 20 of 2018 and the equivalent laws of all other GCC jurisdictions.

Agents are required to complete Know Your Customer (KYC) verification for all transaction counterparties. Property Aster provides KYC tools within the platform but does not relieve agents of their independent regulatory obligation to verify client identity.

05 — Liability & Disputes

Liability Limitations & Dispute Resolution

This section sets out the extent of Property Aster's liability to users and the process for resolving disputes. Please read this section carefully as it affects your legal rights.

5.1 Platform Liability

Property Aster provides a technology platform that facilitates real estate transactions, compliance submissions and professional tools. We are not a party to any transaction between users and do not assume liability for the outcome of any transaction, negotiation or agreement conducted through or facilitated by the platform.

To the maximum extent permitted by applicable law, Property Aster's total liability to any user for any claim arising from use of the platform shall not exceed the total fees paid by that user to Property Aster in the 12 months preceding the claim.

5.2 Exclusions

Property Aster shall not be liable for: loss of profit, loss of revenue, loss of data, loss of goodwill or any indirect or consequential loss arising from the use of or inability to use the platform, whether such loss was foreseeable or not.

Important: Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, fraud or any other liability that cannot be excluded by applicable UAE Federal Law.
5.3 Governing Law & Jurisdiction

These terms are governed by and construed in accordance with the laws of the United Arab Emirates, specifically UAE Federal Law and, where applicable, the laws of the Dubai International Financial Centre. Any dispute arising from or relating to these terms or your use of the platform shall be subject to the exclusive jurisdiction of the DIFC Courts.

5.4 Dispute Resolution Process
Informal resolution — Contact our legal team at legal@propertyaster.ae to attempt informal resolution within 30 days.
Mediation — If informal resolution fails, disputes will be referred to mediation at the DIFC-LCIA Arbitration Centre.
Arbitration — Unresolved disputes will be finally settled by arbitration under DIFC-LCIA Arbitration Rules.
Governing seat — The seat of any arbitration shall be Dubai, United Arab Emirates.
06 — Cookie Policy

Cookie Policy

This Cookie Policy explains how Property Aster uses cookies and similar tracking technologies when you use our platform.

6.1 What Are Cookies

Cookies are small text files placed on your device when you visit the platform. They help us remember your preferences, keep you logged in and understand how you use the service so we can improve it.

Essential Cookies
Required for the platform to function. These cannot be disabled. They include session authentication tokens and security cookies.
Functional Cookies
Remember your preferences such as language, theme setting and display options. Disabling these may affect your experience.
Analytics Cookies
Help us understand how users interact with the platform using aggregated, anonymised data. No personal information is shared with analytics providers.
Compliance Cookies
Used to record consent decisions and ensure regulatory compliance with UAE and GCC data protection requirements.
6.2 Managing Cookies

You can control non-essential cookies through the cookie preferences panel available in the platform footer. You can also manage cookies through your browser settings, though disabling certain cookies may affect platform functionality.

Property Aster does not use advertising or third-party tracking cookies. We do not share cookie data with advertising networks or data brokers.

07 — Policy Changes

Changes to These Policies

We may update these policies from time to time to reflect changes in the law, our services or GCC regulatory requirements. We will notify you of material changes.

7.1 Notification of Changes

We will notify you of material changes to these policies by email to the address associated with your account and by a prominent notice on the platform. We will give you at least 30 days' notice before changes take effect, except where a shorter period is required by law or regulatory change.

Continued use of the platform after the effective date of changes constitutes acceptance of the updated policies. If you do not agree to the changes, you must stop using the platform before they take effect.

7.2 Regulatory-Driven Changes

Changes required by new or amended GCC legislation — including RERA regulations, REGA rules, UAE Federal Law amendments or equivalent regulatory updates — may take effect immediately without the 30-day notice period. We will notify you as soon as practicable in such circumstances.
